    Default Illinois Name Change Of Minor Son

    I live in Illinois and am checking into how to legally change my son's surname. I was nineteen and single when I had him; I don't know the name of the biological father and no father is listed on the birth certificate. He has my surname.

    I am getting married this October and we would like to know how to go about changing my son's surname to that of my fiance after we get married. Can we apply for, and have his surname changed, without my new husband adopting him? Would that require that my husband's name be put on his birth certificate, or can we leave the original birth certificate unaltered and only change his name on things like social security, etc.? My main reason for wanting his name changed is that I will change mine upon marriage and would like my son to have the same last name as me. I would appreciate some help on this.

    Better than trying to do a name change under the circumstances would be this- after you and fiance are married, fiance can apply to adopt your son. Whether you try for a name change or adoption, either way you'll need to do a diligent search for the bio father, so since you'll have to do that, why not have your hubby adopt and make it all completely legal?
