I am doing my residency in NY on work permit which was issued to me as a spouse of E-2 Treaty visa holder. My work permit is expiring in Feb 09 and my residency will finish in Jun 09 which means I need to get some form of work authorization for these four months. I was thinking about getting H1-b from my employer for this time period and would get it transfered to the new employer once I have finished my residency. My question is that if there is any minimum time period employer has to offer job to even apply for H1-b for the employee. Simple as if my current employer can file an H1-b for those four months for me. My employer is exempt from H1 cap. Should I ask my employer to file for the whole last year of residency? Any help would be really appreciated.
