Hi , I have just found this board so thought I would post for initial help as have no yet appropached a solicitior . My husband of 7 yrs and I have 'come to the end of the road' : I am desperately unhappy and keen to ove out ASAP . We have two young children under 5 yrs . Two questions here .
1. The house has just gone on the market , our first viewers are due today but now my husband says he wants to buy me out and live in the house , he has mortgage illustration drafted up and sent to him but he is doing nothing to actively pursue this . I feel he is keeping the children and I in the house intentionally as he did not want to break up . Can I give him a time limit on this or if we are receive an oofer on the house can i accept ? Mortgage currently in both names . I need my half of the equity in the house to move and cannot get another mortgage until I am off this one .
2. We are going for 'seperation ' rather than divorce for now BUT does this have to be legal , do we need a solicitor to draw anything up to confirm we are seperated ? Also as we are still married how do we fare with owning half of each others possessions as we are seperated but not divorced . Obviously once he has paid me off my intersts in the house will be Nil but there are concerns as we are still married I may later appraoch him for more ( which i wouldnt but he doesnt know that ) Also for me in my new house , I dont him to be entitled to half of my new belongings.
