    Smile Changing My Daughter's Last Name

    I am wanting as well as my daughter is wanting to change her last name. We live in Illinois and I had her when I was 17. She has my maiden name though her father did sign the birth cert. Now I am married and have other children. We would really like for her to have my married name now rather then my maiden name. Do I need the fathers permission for this though he is absent from her life. And what do I need to do to change her name and how much does it cost. Any help would be great, but I am looking to know the laws for Illinois only. Thanks in advance, Summer

    You need her father's permission, or you need to convince the court which has jurisdiction over the custody issues that the name change is in the child's best interest (despite his lack of consent or opposition). If you have to fight it out in court, it's hard to predict the cost. I understand the court filing fee for a name change to be $290, although you should verify that amount with your county court; any legal fees or publication fees would be on top of that.
