ive been in a custody battle w my ex fiance since august of 07.let me give some background.in july of 07 my fiance left are home w kids age now 5 son daughter 2 and started staying at her moms.we started counseling for about a month trying to work things out,she felt i didnt love her anymore and payed no attention to her.my son wanted to be home w me and expressed this in many ways.for that month the kids were home w me more than w her.in early aug07 i found a bag of weed in her purse that she had been carrying in the presence of are kids said she forgot was in their got from her sister and was smokin w her sister.that was it for me.she cried askin what she could do to fix this etc. i stated to her to come home and lets fix are relationship she agreed,if not i was goin to a lawyer and possibly social serv.this was a thursday night,friday she brought her stuff home and stayed through the weekend.monday morn i went to work,came to find her the kids and all their things gone.had no idea where they were.i went straight to a attorney and filed a expatae custody order statin drugs not knowing where they were etc.next day had a temp order for custody.found out they were in a shelter.it took 3 more days and another order and police to ghet our children out of womens shelter but i got them.the first hearin she asked for continuance because of no lawyer and got it.5 weeks later we were in court,my temp order and my custody case were dismissed because she was married within 180 days of are son being born didnt know this.she got kids back. .we then petitioned court to order paternity test on both kids,was granted.5 days after her receiving custody back she filed a protection order claiming abuse for seven years drug use etc.was not allowed any contact w kids for 3 weeks or so.went to court fought protection order and won.her testimony showed no reason for a protective order,dismissed order vacated.paternity test came back nov 12 07 and we immediatly filed temp custody based on drugs false protect order not knowing where kids lived not much contact etc.in dec court issues reply saying wants to hear oral arguments on jan 29 07 will not do expartae.i have to ask her every week when can i have kids.if she gets mad because i file against her she doesnt let me talk to kids or see them for days.no contact on our daughters b day. no halloween with kids because i asked were she lived,said it wasnt important not like im gonna visit them their anyway she said.its been hell for almost 4 months.my 5 yr old son cries when its time to go back to moms says never wants to go back to moms.she has now intrduced a boyfriend into picture spends night at their house etc.my son is confused.ive filed for sole custody from the beginning.ive rented the same house for three yrs now 3bdrms 2 liv rooms 56 acres in the country,kids have own rooms .she hadnt worked for 4 yrs until aug 07,ive been at the same job for over 3yrs 700 am to 300pm 5 days a week no weekends, sole provider for the family.she is a waitress and i beleive goes to school 3 days a week.kids are watched by her mom,wich ive asked to watch them while she is at work, never happened.she lives in low income apt beleives she gets welfare 2 bdrm kids sharing bdrm bad neighborhood.she has informed me of nothing pertaining to kids ,medical ,school ,activities etc.while in my temp custody i informed her of everything medical, first day of school grandparents day .allowed her to talk to kids at least 2 3 times a day,allowed her to watch kids while i was at work even when her visit were supervised allowed extra time w them beyond what her visitation stated.because she is their mother and they love her and thats whats best to be in their lives vjust as she was before all this.i fear my son is beginning to resent her,hes confused and fears when he leaves me that maybe he wont see me for a long period of time.shes made visitation hard i might talk to kids once a day if she feels like it,i almost always call 2 times a day in the morn before are son goes to preschool and at night before kids go to bed.i may have said goodnight to them 5 times since all this began she almost never answers my night call.but when their w me she talks to them 2 3 times aday and always before they go to bed.im frustrated w the whole situation,im worried about temp custody hearing.they have been w her for 3 months now only because of paternity issue.what are my chances of getting them back. does anybody have any advice for me.is their anything i can do to help my case.i just want whats best for our children ,and i beleive that the best is for them to be in my custody,their same home wich theyve been for three yrs.please if anybody has any advice,pointers,anything that can help my case,anything i need to do.i have a lawyer,and im prepared to go all the way.anything helps please answer. thank you........
