    Default Green Card Taken Away After 8 Years

    Hello.

    I have a situation.

    In 1999 I finally received my long awaited green card that my father applied for years back.

    In 2000 I married a non US citizen that did not have permanent residence in USA, but we applied for the appropriate paper work.

    In late 2003 my wife had other ideas, and left with another guy, but fabricate4d a story and scenario, that should deserve an academy award. I was pined in a place that was forced to pleaded guilty to something I did not do. And now I have a criminal record, Class C felony domestic violence.

    I know I was misrepresented, the whole thing was a huge mess, and I was told that don't worry nothing will happen to you in the future.

    Well guess what, something did happen. I have been out of the cutly at least a dozen times since 2004 and about 50% of the times, no one really questioned anything when I entered the country, but the other 50% I would get pulled aside, and questioned, and then finally was released and on my way.

    Last time I entered the country, in NYC, I was pulled aside and was held for over 3 hours, where my Canadian Passport and green card were taken away. I was told that I need to appear in front of an Immigration Judge in my city where I have lived since 1999. I asked the officers if I needed to appear with a lawyer, they said no, and "don't worry about it, you will be fine".

    Well last time I was told don't worry about it it, by my attorneys, look what happened, but this time I'm told not to worry about it, from the INS side.

    What do I need to do? I have served all my sentence, (home detention for 20 days) served comunity service, and paid all my fines, long ago.

    I suspect that my ex-wife may have something to do with this, as she is some sort of trouble, because since she left, I get at least once a month, but usually more often, calls from collection agencies asking for her or the guy she ran away with, as they owe large amounts of money to banks and other institutions. I keep telling everyone that we are not longer married, and I don't know where she is, and with whom, but they keep calling at all sorts of times of the day and night.

    Anyhow, I did not have a criminal record before this, not did I have any incident with the law after this ordeal.

    What do I need to do, will I be deported when I show up at the hearing, do I need to be represented by an attorney?

    You say you have an immigration lawyer? Whatever law enforcement has told you, discuss your situation with your lawyer.

    Have you actually been told that this relates to the felony conviction? If you are sure this is about your past felony record, I believe you should consult your lawyer about what might happen - domestic violence convictions can result in deportation or exclusion. If you aren't sure what this is about, your lawyer may help you understand.

    Hello.

    Actually I don't have a lawyer yet.

    I have talked with about a dozen different attorneys, Criminal and immigration, and everyone has a different opinion.

    Very confusing.

    This has to be about my past conviction, because I have not been involved in anything else that might trigger this, unless there is miss identity issues, but I'm pretty sure thats why.

    I did some digging, and found out what Differed Inspection means. Something IU found out on my own, no attorney could even guess for some reason, weird.

    See when I came into the country , the INS officer did not know what to do, he was confused I guess, and because of this, they send you to your home town, or destination place, where they can look at the situation more closely, without holding me in this case begin NYC, my point of entry.

    So this means now that I will be going to this place and have to obviously explain my situation, take court papers.

    Sure they can decide right there that I'm deportable, and yes DV convictions are deportable, in most states if not all.

    As I mentioned I have talked probably with a dozen lawyers, and most say that you need an attorney, others say, you might you might not, you will know after your date scheduled.

    If INS wants me in costady on that day, and deport me, no attorney can help me there, I mean to keep me out, I believe thats the fair assumption at this point.

    Also I had some colleagues that work with INS look at my case, they can't it's in something called I.C.E. now.

    Just have to wait and see what happens.
