    Default Removing The Biological Father From The Birth Certificate

    I have read quite a few posts by you, and you seem to be very educated on all of these legal matters. I have a few questions.
    Here's the story, My Fiance has two little girls from a previous relationship (two girls 7 and 5). The first child was born in Jacksonville Florida, the second Albuquerque New Mexico. The father of both the little girls dropped off the face of the earth right after the second one was born. My Fiance has tried numerous times to get in touch of the biological father, with absolutely no luck. Now here's the question: We live in Lufkin Texas, 3hours South East of Dallas. We want the biologically fathers name removed from both of the birth certificates, how would we go about this, here in texas? Second, how would we go about changing their last names?

    The mother can not get his named removed from the BC unless a Step-parent adoption occurs. He is the Legal Father of the child and until he is not...he will remain on the BC.

    So after we are married, then we can go through with a step-parent adoption, or can we do that before we are married?

    Well...He would be a step-parent until you marry...

    Most states require a period of time to pass after the marriage before the adoption can proceed. You could google your state and "step-parent adoption" statutes.

    we know you meant to state "wouldn't" rather than would. right?
