    Default Avoiding Collection Agency Calls Over Old Debts

    Ok, I believe the statue of limitations is 4 years in Cali, which means my original creditors have charged off my accounts, since this all happened in 2001-2002.
    I am still being harassed by phone by one die hard collection agency and another by mail only.
    Since the statue of limitations is up, do they have the right to continue badgering me? If so, for how long?

    Also, I would like to get a free copy of my credit report to make sure that what is listed on it is correct, but if I request it, they will then have my current address and I open myself up for the collections agencies who have bought my debts and who have stopped harassing me to begin harassing me again, am I correct?
    How can I get my credit report without opening the possibility of being newly harassed by them having current info for me?
    I have been unemployed and cannot even afford to file for bankruptcy!!!
    Please help! I appreciate your answers and quick response. =)
    One more question.. can a person's wages be garnished if a debt is past the statue of limitations and has been charged off if there is no judgement against you?

    The last time I used annualcreditreport.com, where once per year you can get a free official copy of your credit report from each of the three major credit bureaus, I was not prompted to provide a current address.

    For collection agencies trying to collect expired debts, write to them and instruct them not to contact you. Take a look at the sample dispute letter in this thread.

    I just went to annualcreditreport.com and is is mandatory that I fill in my current address???? And, it also asks if ive been at the current addy for the past two years and says if not, put your previous address???????
    You said this, "I was not prompted to provide a current address", so I'm totally confused!!!

    I said, last time I used it.

    If you don't want to use that free service, you may be able to purchase your credit report elsewhere without disclosing your address.

    Depending on how long you have been at your current address, you can try only entering in your previous address on annualcreditreport.com and say you were there the last 2 years, that may work because if none of your creditors have your current address, and as long as you haven't authorized anyone to check your credit using your current address, then the credit bureaus most likely don't have it either.

    I believe what they are looking for on annualcreditreport.com is to match all of the information you enter, including your addresses to the information that the credit bureaus have on record, all to protect your identity of course. If you get past the address portion, you will then be required to answer several questions about your credit history to prove that you are in fact you. Of course the ideal situation would be for the credit bureaus to have your current contact information, but based on your concerns, maybe you can try it this way.
