    Default Pending Divorce, and Ex Is Charging Up Credit Debt

    Husband and I separated then I filed for divorce 6 months after that. Obviously we had credit card debt together but, when we separated it was minimal less than 7k. He was ordered to pay those bills and he (not I) continued to charge up a much larger bill (on his girlfriend or what else, I'm not sure). Now he is unemployed, not making payments and collection agency is threating me with a lawsuit as the co-signer. What does this mean for me? I told credit card company that if they could provide me with a statement balance as of the date we separated and beyond, that I could try and work with them. They told me that they could send the past years statements for free but any statements older than that there would be a fee. I agreed to pay the fee. Get this...they couldn't accept a payment from me, they could only bill the credit card directly. Then to top it all off, they can only send the copies of the statements to my ex's address, not to me.
    So today, the collector,s last words to me were....you'd better get an attorney immediately. What can they do to me? Can they take my car that is paid for? Freeze mine and my mom's joint checking account? I am just starting a home based business as an owner operator, what can happen to me?

    Get a hold of your divorce attorney immediately and inform him immediately of what is going on. The credit card collectors are going to go after anyone they can to get their money. Once they get you to agree to pay anything...they will continue to come after you, regardless of whether or not you owe the debt. But you need to stop the bleeding.
    You may or may not be responsible for this debt...need more information.

    Get a copy of your credit report. Find out exactly what your dealing with. You need to be sure that he has not opened other accounts in a joint name. Not to scare you but you'd be amazed how easy it is to do. It is a real possiblity since he has no job. Get a copy from all 3 reporting agencies.

    I had a friend that this happened to. She was beside herself with worry. Her soon-to-be ex did the same. There are laws to prevent this and a judge will not look kindly upon his behavior. When she found out about a card she did not authorize, she contacted the department store and a CS rep suggested she call a toll free # to report identiy theft (he told her it was HER identity an not HIS regardless if she knew who was doing it). It's toll free and automated. She did that and there was a 30 day hold on her SS#. This prevented HER from getting credit for this time period (and informed her of this). Then she went to a pay phone and called the # back using HIS ss# to also do the same for him. This also stopped him from getting any credit for this time period and couldn't PROVE it was her. This bought her just enough time to haul him back to court (she also felt some satisfaction in knowing she finally got one over on him). Now, I'm sure this was illegal, and I would never encourage anyone to do this, but you need to find a way to protect your credit.
