SCENARIO
We (me n my fiance) are leasing an apt in an apartment building in jersey city, NJ. We have subleased one bedroom in this 3 bed apartment, after informing mgmt, to this girl "Dirty".
We and Dirty have a 6 month sublease agreement. However the agreement states that both us or her can give 30 day written notice to move out after all early termination penalties are satisfied. In this case, there will be no penalty to either us or her. This contract was signed after all parties were satsfied by its contents.
After 1 month, we want Dirty to elave because guess what.. she is filthy. When we asked her to leave, Dirty told us that she can't move out right now because it is too cold. And after we pointed out that the world doesnt come to a standstill during the 'cold', she said that "I'm telling you, I'm not moving out Feb 1". Besides, the 30 day written notice, which we gave to her Jan 1, we have also emailed her that she needs to leave.
2 main QUESTIONS:
a) What should I do if she does not move out? What are my legal steps, and can I call the cops come Feb 1?
The reason I'm going to the extremes of thinking of calling the cops, is because we will most likely have another person taking up her room, and that person will start from Feb 1.
b) She has still not paid utility bills for December after constant reminder via email. Will I be able to take out the utility bills from the security deposit (it says that in the sublease agreement).
