    Red face Divorce Judgment Divides Pension, But No Further Steps Were Taken

    Judgment to share in pension. No QDRO or notice of any kind has
    been presented by judgment holder. Decades have passed. Question.
    Would a motion for QDRO be successful or does Statute of Limitations or some other law impact estoppel enforceability? Question. With decades of abandonment & delay, IF pension proceeds were to be committed elsewhere what impact might this have on the collectability of original judgment?

    Laws are different in each state.

    All you can really is try to get a QDRO entered, and hope that the court allows it. This will probably be even more complicated if the pension is in pay status.

    Thank you for responding. However, I am the pension participant, my ex 23 yrs beyond the filing of divorce with decree of pension sharing, is NOW
    seeking for the first time a QDRO. This is also 9 yrs. beyond the beginning of receiving of pension payments. No notice, no motion, no
    indication to collect of any kind until now. I believe statute of limitations
    time barrs this action? Your opinion? Any pointers? Again, Thanks.
