    Default Pleading "Not Guilty" Even Though It's Obvious You're Guilty

    I was caught shoplifting and I handed over all the stolen items in the security room.

    Now, can you still plead "not guilty" even though it was evident that I shoplifted because I returned the stolen items?

    If I plead "not guilty" in court, wouldn't the judge just roll his/her eyes?

    maybe but it is your right to plead as you believe or want to. It then becomes the states responsibility to prove you guilty should you plead not guilty.

    Guilty people plead not guilty all the time. That is the only way you are going to get a trial.

    Ok. But if I plead guilty, then the security guard would simply bring up the fact that I returned the stolen merchandise (clothes) that was concealed on me. The exact same merchandise they saw me taking into the dressing room.

    I'll lose the case in an instant. Correct?

    Based on your statement here yes. Do you have an Attorney? You need one as you clearly have no clue how to deal with this

    If you plead guilty, the security guard won;t be involved as there is no need for a trial. If you meant you would plead not guilty, then you will have a trial and the security guard will answer whatever questions the DA asks him.

    Now, my court date (first appearance) is in a month. I am the defendant but who will the prosecutor(s) be?

    Would it be the security guards from the clothing store or the police officers that arrested me? (one of them really hated me)

    The Prosecutor is the District Attorney or ADA (assistant district attorney). The Security Officer is only a witiness and will only be called if case goes to trial

    Actually, the LP person who processed you at the store may very well appear to explain what happened to the Judge. If you plead not guilty they will say nothing and return for your trial. Most retailers require their LP staff to attend.
