The Prosector for the County called me yesterday to let me know that he was rescheduling his motion against the NCP for non-payment because the NCP is already serving time for Felony Non-Support. I was told even though that he is in jail that the payments are still to be made and that when he gets out of county jail that he will be going back in for not paying. Wouldn't that mean that the non-payment will be agaist the felony and he goes to prison?? The NCP has not made "full" payments as ordered for the last 3 months (not including Jan) I think he figured what was coming out of his paychecks (even though he cut his hours and did side jobs) was enough because it was court ordered for income withholding. Confused to which takes over - - the State ruling or the county's ruling.
