    I want to sue the lady in small claims for the false statements she made to the police in October. She did the correct thing in November. In November she came back from Illinois with her papers proving it is her house. She showed it at the police department. An officer arrived to the house and asked me a few questions. He also wrote down my ID. He gave the information to the lady in the police department. I received a letter from a lawyer in December explaining the lady wanted me to move out by January 7 or a she will evict me. I moved out without an evition.

    I want a attorney to sue the police department because her false statements still does not give the police to search the house.

    One good question is if I sue the lady first in small claims court first, will it interfere with me suing the police department in a civil court?

    Oh. You are basically talking about a slander action and the fruits of it, mental distress etc. See if the code section I pointed out permits such.




    One good question is if I sue the lady first in small claims court first, will it interfere with me suing the police department in a civil court?

    I do not know.

    You really need to speak to an attorney for some clear legal answers.

    Yes, my first step is to look up the code you pointed out to me earlier. When I find what represents me the best, I will show it to an attorney by going thru ACLU, NAACP and Michigan Legal Aid.

    That tends to sound like consent. In that case, they did not NEED any probable cause or exigency. And, of course, they were told and apparently had reason to believe you were an intruder. The short time frame of the contact was sufficient to determine you were NOT an intruder. I doubt the police will be liable. You can always TRY to sue the lady, but I doubt that you will be able to show that she intentionally and maliciously made false statements to the police to get you in trouble.

    Consult that attorney.
