    Default Possible Federal Employment

    Ohio

    I am applying for a federal Employment position. My background is clean except about 6 years ago I got a minor misdemeanor - Disorderly conduct charge, (knocking over a newspaper box at a burger king). A fine of $25. I checked "No" to the "have you ever been convicted of a felony charge" question. I do know from other people that they do perform an accurate background check. Did I do the right thing by checking NO or would a background check reveal I lied and possible get fired after possible hiring?

    Heres the kicker. When I got the charge, they told me it was like a traffic ticket and not a big deal. I went a year later to the police station to get a copy of my records and nothing came back, but if you go to the municipal court website, that listing for disorderly conduct shows up, but so does a speeding ticked from like 8 years ago.

    If you were convicted of a misdemeanor, and have no other convictions on your record, then you have not been convicted of a felony.

    I guess my concern is will the federal agency I am applying for see that as a criminal act? I figure a felony is something serious. Though my misdemeanor is listed as criminal as a category, but thats all on my record and it was 6 years ago.

    I didn't want to get hired and work there for a while and they come back and say we found a misdemeanor-disorderly conduct on your record, you checked no and now we have to fire you.

    A misdemeanor is a criminal act. It seems reasonable to infer, though, that if they were interested in your misdemeanor record they would ask about it.

    It seems as though the record checks don't complete until after hiring. A friend of mine has been working at the same facility for about 2-1/2 months now and I just got my reference paper for her that the govt. sent out last week.

    If the employer only asked about a felony & you got a misdemeanor, you answered the question on the application correctly. You should be ok.
