    Question Establishing Travel History Of An Officer On A Particular Date

    State: NY

    Hello everyone,

    I'm having a problem with being able to prove a certain officer arrived on the scene, along with the other officers. Meaning... About a year or so, I was at the wrong place at the wrong time, when a bunch of officers walked over to me and asked me alot of questions. After they were done, I asked for one of their shield numbers and found out the hard way, that as a citizen, I should never have done that. Because I was swiftly arrested, held for 8 hrs, then released with no charges. (Guess they wanted to teach me a lesson). The day this happened, about 5 or so patrol cars pulled up. From what I remember, there were alot of officers and only 2 supervisor officers (Sergeants).

    The Problem...The supervising officer who was there to give the order to arrest me, is claiming he was never, ever there!

    The Questions...What are some possible methods to find out where this Sgt. was during that day? Would there be a GPS device in his patrol car(This is a NYC police Dept Vehicle)? Or a certain log report? (Not sure what its called)...but maybe a radio record of Sgt. to dispatch?

    As you can tell, I'm not familiar with the steps/protocol that cops must make when they arrive to the scene. I'm hoping that someone on this forum, might know of a way to prove this Sgt. was there when I was arrested.

    I truly would be very, very thankful for any help.

    Make an open records request of the PD for any and all documentation indicating the whereabouts of Officer Smith on October 17, 2007, this request includes but is not limited to any schedules, computer files, print-outs, hand written notes/tickets, diary entries, and/or dispatch notes.

    You do not have to identify your request as a open record/public record request, but it must be in writing.

    They cannot ask you why you want to info (although you certainly can tell them if you want), but they can call and ask for clarification of your request (like if 15000 pages of daily computer page notes have his badge number at the bottom indicating he was on duty that day, do you want that? Well, obviously, no).
    They can charge you for the time and materials to compile this information, but you can also ask that they compile it and you will come down and look at it then ask only for copies of the information that apply to your situation.

    Redt...I cant begin to thank you enough for taking out the time and helping.

    What department do I address this request to and where do I send this request. I assume it MUST be mailed and not faxed or hand delivered...right?

    Is it possible that the Pct the Sgt. works out of, might have additional information, or does 'everything' get copied and forwarded to a central location? If you say that the Pct might have other info...can I make a request to the Pct?

    Last question...Is there anyway I can expedite this request, as in...pay extra, cry, beg...etc etc?


    I truly am so very thankful for your advice and wish there was a way to return the favor...but as you can tell, I'm very new to this and don't know much. You are a great person and wish you the best.

    One thing that might help, if you can afford it, is to have a good lawyer make the request on your behalf. This will probably cost a little extra, but it might be worth it in the long run.

    First, here is the public information law in NY - http://www.dos.state.ny.us/coog/foil2.htm

    You can't really expedite it beyond the law, but the law says:
    Each entity subject to the provisions of this article, within five business days of the receipt of a written request for a record reasonably described, shall make such record available to the person requesting it, deny such request in writing or furnish a written acknowledgment of the receipt of such request and a statement of the approximate date, which shall be reasonable under the circumstances of the request, when such request will be granted or denied . . . Sec89 3(a).

    There should be information on making an open records request on the police department website - they may allow requests by fax or email, but they will probably designate the email address or fax number to send it to.
    It took me less than a minute to find this: http://www.troopers.state.ny.us/Sear...archResult.cfm - the first search result contains info for NY Staties' Public Info office.

    Look to whatever jurisdiction this officer is from (city/county/state). That's where all of the info should be contained - even some central records location is going to fall under the control of the jurisdiction that this officer works for.

    Redt...the second link you provided does not work. When I click it, it loads the site but in the site it says 'Your search cannot be blank'. And lastly is it possible some info might be only stored at the Pct? If yes, then can I make a request to them also?

    You can make an open/public records request to any government entity. If you think that there may be info at the Pct would not be sent with an open records request to the govt agency, go ahead and ask. If they feel that what you are requesting should be confidential they can redact (black out) the confidential stuff or with hold it, but it really doesn't hurt to ask.

    Oh and on the 2nd site type "public information" in the search box. : )
