    Question Not Being Given Early Release From Probation

    Hello,

    I am 18 and I live in Wisconsin. I was recently charged with possession of THC and my sentencing was probation for a 12 month period, with minimum supervision, which is only seeing him once every 3 months; with the possibility of early discharge at 6 months. My question is, the first day I went in to meet up with my P.O. he wanted to drug test me but I couldn't urinate, he had asked the last time I had used was, and I had said 1 month ago. We went into his office, he explained my rules, and that probation will last for 12 months. I had asked him what about the possibility of early discharge, he said no way, and explained because my first drug test would have been dirty(which he didn't even drug test me he just assumed it would be dirty), and because I am on minimum supervision seeing him only once every 3 months. I was baffled because that's what I was hoping for... I also have an attorney and had one with me for the duration of court. All help would be appreciated, I want early discharge, I want to move and move on with my life.

    Your sentence "was probation for a 12 month period, with minimum supervision, which is only seeing him once every 3 months; with the possibility of early discharge at 6 months."

    It appears since you could not give a urine sample, so a drug test could be done, your PO has decided to take that possibility off the table.

    So I wouldn't be able to get my attorney and go back to court for that?

    I'm sure an attorney would be happy to take your money.

    However, the probation officer is doing his job and, in my opinion, had you been able to provide a sample and you tested clean, the PO may have allowed for an early discharge, but he/she doesn't have to.
