    Default Amending A Complaint To Request More Damages

    I filed against my neighbor in small claims. They have free legal and moved it into District court. I want to raise the amount of my claim but can not find a Michigan form anywhere to Ammend a summons and complaint, just the actual Summons and complaint. Original small claims form did not have nearly the detail it needs now and also was limited to $3,000.

    If anyone knows where to find a form to Amend a complaint or if I can just use the normal summons and complaint and state there is already action?

    I asked the court for the form and they told me I need a lawyer to get and file forms?

    There's no magic form for every legal need. Sometimes you have to draft your own form. You would draft a new complaint and submit it as your "first amended complaint". Depending upon how long it has been since the complaint was answered or the case was moved to district court, you may have to get court permission.
