    Default Getting Rid of an Unwanted Roommate in Florida

    I need some serious help! I currently live in an apartment with two roommates, where the landlord is my father. I have been living with one of my roommates for 2 years now and everything is just fine, but we recently needed to find a new roomate. The new roommate is nothing like she told us she was. She has been living in the house for 2 months and is not some one who we would like to continue to live with. In our apartment the electric and cable bills are not included so me and my two other roommates are soppused to split the bills. So far the past two months she has paid substantially late on everything including rent. Rent is not really my problem, but the bills are in my name so if she decides not to pay them, or pay them late I get screwed. On top of not paying bills she has had a guest stay over who stole my perscribed medication. On top of theft this roomate is filthy she keeps the apartment in terrible condition. The lease says that any fault of the rent or lease agreement will lead to an eviction notice and then you would have 10 days to shape up your act of you gets evicted. So what I think that means is that she can potentially not pay her rent then 10 days, and then pay it on the last day of eviction and be fine for another month. The last thing I want to do is go to court, because her dad is some big hot shot lawyer, but my other roommate and I can not live in misery for another 10 months. So the questions I have are, Is it possible for my roommate and I to sit her down and tell her things are not working out and we would like to find a new roommate? How do we get her to leave without going to court? and how to we go about doing this in a legal manner? Also do we have the power to evict her?

    Do you have a lease? When does it expire?

    Yes she just signed the lease for 12 months and it is not up until september 15th 2008...We need to get rid of this roommate she is ruining our life.. PLEASE HELP

    If she's on the lease with you and your roommates, and the lease isn't up for nine months, about all you can do is have your father evict the lot of you. Assuming there are valid grounds.
