    Default Imputing Wages In To Calculate Child Support

    I have worked since I was 14 years old in businesses owned by family members. Three years ago I quit working full time as my husband made more than enough to support our family. One year later my husband moved out of our home, in with his girlfriend and filed for divorce.

    Three months later I went back to work for family. This year I sold my house and was then laid off from my job when the business closed down. I have been living off my house profits while looking for work - with no luck. I have decided to go to college so I will be more employable.

    My X says I 'hid' income and could/should earn way more than I have. I say that I was overpaid because my family treated me - well - like family. According to unemployment office aptitude tests my math is at an 8th grade level - but I do have a high school diploma.

    I understand a judge is supposed to 'impute' my wages to calculate the child support. Is there some sort of formula the judge will follow?

    It's not so much a "formula" as it is what the judge has seen in the past.
    For example,
    A 35 year old woman, with a bachelors degree in the field of *whatever*, and a 15 year old child living in *such and such* part of the state, could be making xxx a year.
    The judge has seen it all, and is usually pretty close in calculating a wage.
    The fact that you are going back to college will show the judge that you are serious about entering back into the workforce.

    Does it matter to the judge that I had intended to stop working permanently the year before my X left - with my X's consent?
    Are there any sorts of tests I should/could take to backup my claim that my family overpaid me based on my skills?

    As far as what the judge will say you should be able to make, it's a crap shoot. And it's not something you should lose sleep over.
    If you were making 30k with your family, and most people in your field make 20k, then explain it to the judge the best you can. Unless you were getting paid an outrageous amount of money over and beyond, it really won't make much of a difference in child support ( as you are on the receiving end).
    Find your states CS calculator guidelines, and fill it out twice. Once using what you made, and once using what you THINK you could make. Look at the difference. It won't be much.
    There is a website, I forget what it is, that tells you what the average income is, for a specific type of job. My mortgage guy showed me last year, when we went to apply for a mortgage. Maybe someone else knows of it. Try asking about it in a mortgage msg board.

    OH! You gave me a great idea... I looked on the bureau of labor statistic's web site and found a TON of info about the average wage for people who do what I did etc. THANKS again Dad2
