    Smile Changed My Mind About Moving Into Apartment In NYC

    I recently looked at a rental apartment and initially liked what I saw. The area was where I wanted it had 1 more bedroom than my current apartment and the space looked nice. Here is my dilema..I was pressured to leave a deposit and sign a rental agreement rather quickly (December 20th)since the landlord was going out of town and not returning until the end of December (29th). I gave a depsit and signed the rental agreement and the landlord left the keys with the real estate so I could borrow the keys and go measure windows,etc prior to moving in January 1st. When I tried to get into the apartment, I had much difficulty due to the fact that they only left me 7 out of the 8 keys for the apartment. I rang one of the other tenants bells to get in. After entering the apartment in the daytime, I had a better view of the apartment which needed to be painted, some of the windows would barely open, the deadbolt locks on the entrance doors would only lock after fiddling with them, the floors did not meet the walls leaving a 2 inch gap where there should have been mouldings and other various issues. I didn't initially notice this because when i looked at the apartment it was nighttime and the only light in the apartment was in the kitchen and bathroom. These conditions were not satisfactory to me and I notified the real estate on December 26th that I did not want to move forward with moving in. The real estate gave me back the portion of rent that I had paid, but now the landlord does not want to give me back my security until they rent it to someone else. They had a delay in showing it to other tenants because they were out of town, which should not fall on me or be my responsibility. What is my recourse with this situation if any?

    NYC's housing rules are tricky, and there are some deficiencies with the apartment which sound significant, so consider checking with a tenant's union in the city or a local lawyer to determine whether they are sufficient to get you out of the lease.

    did they stop advertising it or anything? that money is kinda owed to them because they held it for you.
