I'll keep this story short and as simply a summary. If anyone with advice with like the full story, please feel free to PM me.
Last night, an ex-girlfriend sent me a text message on the phone asking for pain killers. I called her and she said she needed enough to kill herself. There are events that occurred yesterday to cause her suicidal thoughts. I said I would bring her some and left my house. On the way down I got multiple text messages stating that she really needed them. I went down without pills.
When I got there, I met her in a parking lot just outside of her apartment complex and got in her car. She had been drinking heavily from her speech and the smell of her breath. I told her I did not bring her pills and that I was not leaving unless 1) I called the police or 2) I stayed the night at her apartment to make sure she would not kill herself. She told me to get out of the car, that she would just drink herself to death. I said no. She tried to drive away with me in the car; I took her keys from her. She got out of the car and began to walk to her apartment. I followed her for a while, telling her I would not let her do this. Finally, after her yelling at me and eventually hitting me, I stopped following her and called the police.
The police arrived shortly after. I told them what happened and showed them the text messages. They got in contact with her family, found her, and informed me she was alright. I then went home.
This evening, a police officer served me with a restraining order. In the restraining order, it has her stating to the police officers that filed the report that I agreed to leave her alone and not bother her if she met me. It goes on to state that I have been constantly bothering her since we broke up.
First, the statement that I was coming to talk and then leave her alone is false. I was coming to stop her from killing herself. I have text messages to prove it and two separate phone calls to 911 asking for them to come stop her. Second, up until last week, she was coming over on her own will to my house almost every week, sometimes multiple times a week. Third, she began contacting me after over two months of no contact between either of us.
The report goes on to say that I threatened to call the police if she would not talk to me. I threatened to call the police if she would not allow me to make sure she would be alive in the morning, which I also told the officers.
All of the claims she made in the report for the restraining order are false. Tomorrow, I plan to go to the police station and file one against her for obvious reasons. However, I am also considering bringing up the fact that she filed a false report.
My questions:
1) Judging from this brief overview, is my claim that she filed a false report valid?
2) What kind of penalties can she face if convicted? We both live in New Jersey.
3) If she is convicted, can I get this restraining order wiped off my record?
