    Default Rental Agreement Prohibiting Washers and Dryers

    I live in NJ in a apartment complex with more than 200 units, our lease calls for no washing machine or dryer on the premises. We know there are many tenants that have and are currently using washer and dryers in their apartments.
    Now landlord is has given me a “Notice to Cease” or we may be evicted according to NJ Law (N.J.S.A 2A: 18-61. 1(c))
    “You are in violation of the landlord’s rules and regulations, which were made part of your lease agreement. Your lease prohibits the operation of washing machines, dryers and altering electrical and plumbing within your apartment.
    Specifically, you’re operating a washing/ dryer machine and altered electrical and plumbing in your apartment.”
    “This behavior must cease within 10 days from the receipt of this latter and remove the washer and dryer permanently from your apartment or will have no choice but to begin legal proceedings to have you evicted from your apartment. We will inspect your apartment at the time to ensure that you’ve complied.”
    Now, disconnecting and discontinue the use of the machines is the easier part, but could I be evicted because the landlord also want me to remove same from the apartment ? I don’t have any place to store these two pieces and also I have a list of about 5-6 other neighbors that have and continue to use their washer/ dryers and the landlord is not asking them to remove them from their apartment.
    What king of recourse (if any) do I have at this point?

    You are in violation of your lease if you do not comply within time frame asked yes you can be evicted

    I understand that there is a violation of the lease, however, now the appliances are turned off and disconnected, therefore, we have ceased to use them, why do we have to remove them from the premises ?, there’s nothing on the lease regarding that issue. It’s my apartment and I’m keeping them until my lease expires and/ or we move to another location.

    The other tenants that also have the same lease and still are keeping and utilizing their machines isn’t that a double standard ? Is it not my business?

    Please clarify it for me.

    The other tenants are not your issue. Fact lease says you cant so you dont! Yes the are other tenants you believe have an use these machines. However you do not know what agreement they "might" have with property owner. Bottom line is if you want to avoid eviction get rid of the machines

    I would not expect the landlord to accept that you are in compliance with the lease, merely because you unplug your appliances and disconnect the water supply.
