    Default Can A Quit Claim Deed Be Used To Release A Deed Of Trust in California

    We are the beneficiaries of a trust deed on California property owned by my husband's brother. He has paid off the loan and we would like to reconvey the property to him. However, we have misplaced the trust deed and note which are required to be presented along with our signed reconveyance of the property. In the absence of these documents, might a quit claim deed serve the same function, releasing our rights as beneficiaries to this property?

    Why would he settle for anything less than a warranty deed?
