    Default How Long Does It Take For A Father To Give Up Paternity Through Not Paying Support

    i have two children by my ex who just got married. he has never paid support, we split two years ago and he was to send me money instead of us taking it through court, he did for a few months the stopped and has not really had anything to do with his kids for two years. A friend of mine told me after a while of no support and no contact i could get his name taken off their birth citerficates with filling it and placing it in the paper a few times... is this true and what exactly are the laws about this? Can i remove his name with out going to court?i currently live in Indiana if it helps any.

    First- do not listen to what your friend says- they are totally wrong.

    Second- You cannot ever just simply take a father's name off of a birth certificate. You can however, have the court issue an order terminating the father's rights and then for a name change.

    Third- You cannot even begin to establish abandonment for non support unless there is a court order, which you do not have.

    You need to file for a CS order, then if dad refuses to pay and has no contact for a couple of years, then you'd be able to file for a termination of rights.

    You should get a consult with a local attorney to find out what it will eventually take to prove abandonment, but your first step is to get a CS order.
