    Default How Much Notice Do You Have To Give?

    Hello,

    I live in a privately owned apartment in Los Angeles. I have a lease with the owner, which has expired and since become a month to month agreement. I rent out the second bedroom on a month to month basis. The new tenant just moved in on Oct.1/2005 on a month to month basis with rental payments due on the last day of the month. He apparently just "lost his job" and has given me notice to move on Nov.15/2005. Does he not have to live in the unit a month before being entitled to giving notice? He is also not a U.S. citizen and here on a tourist visa working under the table.

    He has suggested that he may "skip out" and so I now feel unsafe with this person in my home. What are my options? Please respond asap...would be very much appreciated!

    Default One Month's Notice

    A month-to-month tenant can move upon one month's notice. Under California law, there's no requirement that the tenant reside in the apartment for a minimum period of time. (In some states you have to give a full rental period's notice, which would have the effect you describe, but the modern trend is for notice to begin on the date it is given. Landlords have often pushed for that reform, as it is often they who are seeking to terminate the tenancy.)
