    Default Consequences of a California Speeding Ticket

    I was recently pulled over for a +95 in a 65 however, The issuing officer, who seemed sympathetic to my reasons, advised me that he was writing the ticket for + 80 so I would not have a mandatory court appearance and I would not have my license revoked etc.. etc.. I see on the citiation that in the Speed Approx. Field - is a value of 95 PF - Max Speed was 65 and there is a " Special " field that lists a value of 81. I have a mandatory court appearance from the Central Justice Center Orange County, my record has been clean for the last 4 years. Does anyone know what the " Special " portion of the citation means, and If I may still be elegible for Traffic School ? This is a company vehicle, and I would not like to lose the company privelages due to this infraction. Any advice would greatly be apprecaited. Thank you.

    Contact the clerk of court and ask about traffic school. If she says no, ask her what is the probablity of the judge granting traffic school when you show for court.

    No traffic school for those who are going more than 26 miles over the speed limit in CA, so if he cited you for going 80 in a 65, then you are good to go on traffic school.

    But it is only 1 point on your record if you choose to just pay it (but if Traffic school is an option, choose it).

    No traffic school for those who are going more than 26 miles over the speed limit in CA
    The judge still has the option of approving traffic school.

    Which method were you pulled over in the OC with? Was it the Sheriffs Dept or CHP? Which law were you charged under? Methods of fighting this depends on which mode you were tagged with. Radar, Laser, or
    Lidik?

    You can appear via mail through a Written Not Guilty Plea (pursuant to CVC 40519(b)). In your plea you can request a Trial by Written Declaration (pursuant to CVC 40902). In this way you can contest your citation without appearing at all and will have a better chance of winning than at trial. Further, if you lose your trial by declaration, you have 20 days to request a new trial! (a "Trial de Novo" pursuant to CVC 40902-d). You then can appear in court for the first time for your second chance of winning.

    So your defense would be based upon what you are charged with and how he came to that conclusion.
