I had extended my lease for six more months. They "don’t'' extend leases for six months only 12, but they did it in my case. I currently in Houston and am planning to move back home (San Diego) in January which means that I would break the lease. I'm late with my rent for this month and they are charging $700 (including fees) which I told them I am fine with paying, but in addition they want me to pay for the other two months as a penalty if you will. Is this legal? I will pay the 700 that I owe but I do not agree with paying for two months of rent that I'm not going to be living in.
They said that if I don't pay, they will take me to court and will ruin my credit.
Your advice is appreciated.
