    Default Filing a Pro Se Motion in Bankruptcy

    I am a Georgia Pro Se filer BK7 no asset, filed 10/12/05 and discharged 2/06.

    Cell phone company refuses to cease colletion of an IIB debt. And refuse to list as IIB.

    Here is my paper trail

    1 Disputed item 2 times with CRA's to no avail

    2 Sent letter CMRRR no response

    3 Recieved letter from collection agency notifing me they are now taking over.

    4 Sent letter to BBB to try and avoid court intervention.
    recieved call from very BK ignorant representative that basically said he will send it back to collections.

    My question is, Because I filed Pro Se do I contact the Trustee? or hire an Attorney?

    You can try talking to the trustee, but I very much doubt that the trustee will offer to help with this.

    You can bring a contempt motion yourself with the bankruptcy court, if you can figure out how (ask the clerk for a sample from another file - maybe they can help you out), or have a lawyer do it for you.

    Is this bill something that was listed on your Creditors matrix as a debt that should have been discharged? Were they contacted about your filing bankruptcy? Did you check your paperwork that the courts sent to you indicating who had been served paperwork about your bankruptcy?
