    Default Emancipating My Girlfriend

    ughh, once again another topic on fl emancipation. so sorry to bother you guys over this.

    ok, so i think i figured out that you have to be 16 to be emancipated, but is this really true? if so, how can me and my gf get herself taken from her current guardians, who do not properly care for her, and have my parents adopt her? i really need some help on this, because she's going through hell with her current guardians. her mom has passed away, and her dad is even worst than her guardians. all i need is just a basic outline on how to go through the emancipation process and adoption process. any help is greatly thanked.

    The situation seems a bit more complicated than most, and probably more complicated than you anticipate.

    Why is she in the custody of guardians, and not her father?

    right, i should've clearified on that a bit more. her current guardians are in fact her grandparents. she was taken away from her dad because he was proved to not be an adequate parent; i believe this all happened shortly after her mom died. indeed, it is a very peculiar situation, and i'm doing all i can to try to help her. as of now, i'm try to get a hold of the Escambia County attorney's office to ask some questions about emancipation and being put up for adoption.

    her grandparents are just as bad, if not worst, than her dad. so far, i've got verbal abuse (calling her a slut, whore, etc., etc.), not properly caring for her (in this case, not taking her to a doctor for proper treatment), plus, and this probably won't matter much, but her grandma is drunk almost every night, plus she has access to alcohol and her grandfather's prescribed medicines.

    little by little, they're destroying her happiness and her life as whole. they won't even take her to get a prescribed drug for her bipolar depression, which often results in her suicidal days, which in turn causes her to cut herself.

    Default Emancipation of Girlfriend

    It appears, then, that her grandparents became guardians through a court process, and are likely to be removed as guardians only by a new order from the court. Also, under Florida law, they would be the ones who would have to initiate a petition for emancipation. (And yes, she would have to be sixteen to be emancipated under Florida law.)

    damn, i was hoping i might be able to find a way around the age requirement. how 'bout adoption? if we could get some kind of hard proof, wouldn't the proper authorities be forced to take her out of their home? in which case, would they assign her to a foster family? or could she say she prefered to be with me and my family?

    Default Child Dependency Action

    From what you have said, it appears that she may have been placed with her grandparents as the result of a child dependency action, in which case there should be a file on her situation, and there should be a case worker assigned to her. It would also be likely that her grandparents passed a home study. It is difficult to speak to this situation without knowing the full background.

    i see your point. where would i find out about the file and case worker? would i simply have to contact the County Attorney's office?

    Default Dependency Action

    Your girlfriend should know if there has been an action, may have court papers with a case number, and should know who her case worker is.
