    Unhappy Court Supervision For a Red Light Citation in Illinois

    On 7/29/2007 - I got the ticket 30 min after midnight. ( I have no previous citations or car accidents in entire lifetime , and I did not run through the red light )

    In the Court - I plead NOT guilty
    Trial Continuance was granted 3 times

    When I brought the witness on trial 12/3/07 with me who was in the vehicle at the time of alleged violation, the prosecutor offered me Court Supervison.

    The judge told me, I can plead "NOT guilty" but 'based on assumptions what would happen IF we would go to trial, she could stipulate I would lose the case ( just like that ) , so she could enter 'not guilty' but find me 'guilty' based on such stipulation.

    I had no chance for trial, so officer got off the hook without proving anything. I really was heart broken. There is no justice here.

    I was ordered to pay $255 on 12/3/07 and got 2 months to pay out.

    - officer's citation did not have clear location ( I could nor read excatly where he said it happened, 6 people who tried to read it could not figure out excatly what 2 streets he listed on citation )
    - The police department have never gave me any paperwork, such as policy for giving citations, notes if he had any, or any thing I could use.
    - after my witness was announced the 1st time, suddenly his witness "materialized" from nowhere next time.


    Is there anything I can do about it? I have very little time to act. Please advice. Or should I simply stick with Court Supervision and write offical complaint to his Chief of Police, and to Mayor of the City to tell about his attitude, and me ending up with citation, supervision and $255 fine for something I haven't done, and I did not deserve!

    This "court supervision" is what? A deferment?

    Welcome to traffic court. Court supervision is a deferment. If he does not get another ticket within the probation period, the ticket will not show on his license.

    The 255 is just another tax and you were the one selected to pay. This tax pays the salaries of the Chief of Police, the judge and the mayor. If the state asked for the continuance and you were in court you should have made a motion for dismissal. This judge obviously wouldn't have granted it but you should have put it on the record.
