    Default Recovering Repair Damage For Accident On Private Property

    Hello,
    I am new to this forum and live in Michigan. I wish everyone a happy new year! I was leaving a fast food restaurant driveway (2way with arrows) and was hit by a woman coming in from the street, she was not looking at the road, she was leaning over the passenger side doing something and came over to my side of the drive and hit the gas, running into me head on.(The collision happened when we were both on private property) I have no fault limited liability (basic coverage, no collision) she has full coverage. I would like to know how I go about collecting for my repair damages? As she was at fault. Approx. $2,000 . The police did come out and make a report stating she ran into me and I took pics on my cell phone showing my car on the arrow and the damage to my car along with pics of her car. I was told I could only collect $500 max because of the no-fault law? Is this true? Can I sue in a small claims court? Any advise would be greatly appreciated! Thanks! Joe

    In Michigan you can collect your uninsured losses up to $500 (as you were told) under the state's "mini tort" law, but you are otherwise responsible for your own collision coverage. You will likely receive that $500 by making a request with the at-fault driver's insurance, and (if they request) documenting that you had no collision coverage.
