    Default Retail Fraud 3rd Degree At Macy's

    i was caught shoplifting from macy's a few nights ago and they charged me with 3rd degree retail fraud.(this isn't my first time shoplifting at macy's but i've never been caught before ever) they took my picture, took the pictures of the item and they copied my driver's license. Then they gave me this paper saying when my court date is. this is also my first offence or misdemeanor or anything... i have nothing on my record

    1: whats going to happen to me, in court and stuff. should i plea guilty and will they put me under hyta? what ever that is.... what will be my punishment?

    2:the store has surveillance tapes... do you think its possible they would go back and search through the tapes just to find me?

    oh my!
    i am convicted of the same thing. i am an adult. my record is COMPLETELY clean. and i was also shoplifting at macys (3rd degree also) and also unsure what to plead? and if i should have a laywer

    also i heard we will have anywhere from 3- 1 year of probation. and maybe some community service.

    but i know we have a civil penalty fine.
    which is whatever the amount that you stole / shoplifted.
    the penalty can be up to 10 times the amount.
    but to not exceed 1000.000. and no less than 100.000

    i also DO NOT want misdemeanor on my record.

    iamsosorry, I suggest that you consult a criminal defense lawyer and have your lawyer help determine if you are eligible for HYTA. (You must be between the ages of 17 and 21). There also may be a diversion program available in your county, although those don't appear to be common in your state. I doubt that they will review old surveillance tapes for additional incidents, but note - you need to stop shoplifting. Right now you are probably scard enough to think you are going to stop, but you have to actually do it. HYTA, if you get it, is a one-time special deal.

    pinkprincess33, you really should have started your own thread and identified your state. I assume you mean "charged" and not "convicted". Talking to a lawyer is a good idea, particularly if you are looking for a way to avoid being convicted.
