    Default Obtaining back and future rent from roommate

    I have a rather long question. I have a roommate who has not paid me any rent since May 2004. She and I are both on the lease. I pay the full amount of rent and would like to know, how should I go about getting the her portion of the rent. I have asked her verbally and in writing to pay her half of the rent and her half of the utilities. She does not. She owes me more than $5000 dollars and it keeps growing. I have asked her to move out since she is not paying rent, and she again refuses. Would it be my best move to take her to small claims court to recoup my money? I pay the rent, so it is not late, I don't want a mark on my rental history. I know it also shows she is paying too on her rental history. I just need some advice please.

    Default Deadbeat Roommate

    It sounds like you should consider approaching your landlord about concluding your present lease arrangement, and then either release the apartment on your own or move to another unit within your complex without the roommate.

    The best place to try to get a judgment for back rent is probably small claims court, depending upon the jurisdictional limits for damages you can obtain in that court. But it sounds like you'll have difficulty collecting any judgment.

    Thank you for your response. I was going to talk to the apartment manager next week and find out from them what I should do. I was considering moving to another unit within the complex, but I hate to move twice, because I am thinking about buying a home soon. I would like to have the roommate move, to me that makes more sense. As for taking the roommate to small claims court, I might pursue that angle as well. If I get a judgement in my favor, they may garnish her wages, whenever she gets a job, and I might be able to get some of my money back. Thank you again.
