Yes and yes.
However, you should know that there are very few Vehicle Code violations that can apply in a private property collision situation.
The chances of a citation coming will depend on what it might be for. if it was for the bad driving, then it's not as likely ... if it is for no insurance, no license, or something else to do with license, registration, or equipment, then it becomes more likely that a citation is possible.
If no cite was issued at the scene, the chance of one being issued later for a private property collision in CA is very slight.
