    Default FMLA Leave For Parent of a Hospitalized Adult Child

    My son has Type 1 diabetes (aka juvenille diabetes). In March he was in the hospital for 3 days with diabetic keto acidosis and early stages of kidney failure. My employer says adult children do not qualify me for fmla for a family member. Is this true? I find it troublesome that if this was my husband, mother or father I would have gotten to use fmla. Thanks for your help.

    Yes, it is true. Children over the age of 18 are not qualified dependents under FMLA except in very limited circumstances.

    The only time a child 18 yrs. of age or older would qualify as a "dependent" under FMLA would be if they are incapable of self-care because of a mental or physical disability.
