    Default Breach Of Oral Contract, But Agreement Was Verified To The IRS

    Hello,

    I need to know what my rights are. When I quit my job my employer refused to pay me all of my commission/bonus that was agreed upon when I was hired. At the time he said I had no recourse because it was his word against mine. However, things have changed since the IRS got involved. I now have written documentation from the IRS that substantiates our oral agreement. My question is what is the statute of limitations for this for the state of Hawaii? Also what type of claims would it be? The amount is @$50k. Thank you for reading this post and for any help that you can provide.

    You need to take all of the information to an attorney and let him review your case and advise you whether you have any chance of recovery.

    I agree. The IRS has no authority over contract disputes.

    I agree with the others, the IRS may be able to provide a paper trail, to help your cause, but a lawyer would be the one to tell you whether the paper trail is enough by itself. I hope it all works out for you, this is a large amount of money. Let us know how it goes, if you feel comfortable doing so, and your lawyer tells you you can, we do care!

    Hi, thanks for the replies. Sorry I didn't explain more about the IRS. My former employer issued w-2s for my salary and 1099s for my bonus income. The IRS questioned us both and deemed that the 1099 income should have been included in my w-2 wages. My former employer wrote a letter to the IRS that confirms what our oral agreement was. It was just my luck that IRS investigated and that my employer verified our agreement.
