Hi,
I am recently (this summer) divorced and have primary custody. This is my ex's 'year' to have the kids for Christmas (5 pm Christmas eve until 11 am Christmas morning). I have been asking him for a month now if he plans to have the kids during this time, and he has not answered yet. Now Christmas is less than a week away and I still don't know if I will have the kids during this time or not (I would love to have them for this time).
Is there a point at which I can just say that I will plan on having them? Or must I assume that he is going to have them even though it is likely that he won't?
Other info:
He lives in a different state but comes to our state for visits. He has never followed the visitation agreed upon in the stipulation. He is supposed to have them every other weekend for the whole weekend. What usually happens is that he comes once every 3-4 weeks and takes them for Saturday, and then again maybe for a couple of hours on Sunday. No overnights. It makes it hard for me to plan since I never know from one weekend to the next if he is going to show up, but I want the kids to have a relationship with their dad.
