    Default Chapter 13 To Chapter 7

    I have a Chapter 13 in place. When I first filed I was keeping my house and since then I went ahead and gave my house back to the bank. I one vehicle that I was paying on that is in the Chapter 13. The Chapter 13 is paying all of my unsecured debts plus my vehilce. If I gave the vehicle back could I change over to Chapter 7? My husband filed his own chapter 13 in 2005 for back taxes and arreas on the house. He will be discharged in his chpater 13 in 2009 and then mine will increase to 1000 a month. I want to know if I gave back the secured debt could I change to chapter 7

    You will have to see if you qualify for Chapter 7 under the means test.

    You might want to talk to the bankruptcy trustee. You do have to qualify for chapter 7 under the means test.
