    Default Dischargeable Debt

    New York State

    I am involved in a lengthy divorce proceeding, and have recently lost my job. I was collecting unemployment for several months until I found a new job. The new job pays roughly $17,000 less than the old job. However it is the best job available in this field in this area.

    My STBX's lawyer is filing a motion to have me pay her attorneys fees. This equates to roughly $12,000. I also owe my last lawyer roughly $1500.

    My question is this: will i be able to discharge these debts in a bankruptcy.

    I also have roughly $70,000 in debt relating to the marriage. Any help you can provide would be greatly

    A similar thread.

    As I said there, consult a bankruptcy lawyer now, and speak to your divorce lawyer about your situation now, as you are likely to find that anything that ends up in your divorce judgment is nondischargeable. That is, you may be able to resolve your debts to the creditors through bankruptcy, but you could still end up having to pay the (otherwise discharged) balance to your wife.
