    Default When Can I Legally Tow A Car

    I'm the co-signer/co-owner of a car. My name appears on the title of the car but not on the registration of the car. To my knowledge, there are no license plates on car, no insurance, and no registration. My only legal document is the title and the contract I co-signed, which states I am co-buyer as well. I don't know where the other co-owner of the car is and I don't have keys to the car. She and the car is missing now and she is defaulting on the payments.

    If I do find the car, can I legally have the car towed or have a boot placed on it if my only legal document is the title?

    Can I report the car stolen?

    If you're on the title, you should have an equal right of possession with the other person on the title. The car hasn't been stolen, so it would not be appropriate to report it stolen.

    Since you are aware that she is delinquent as far as the payments are concerned, I imagine the finance company has made contact with you. As such, they have probably advised you that even though you are not the primary borrower, you share equal responsibility. If the loan is severely delinquent, meaning 90 days past due the lender is after the collateral to minimize their loss. New York is a state where the lender must redeem the vehicle to either party upon payment of the arrears. To sum it up, if you want to legally tow "repo" a car, you must be the legal owner. It is a Civil matter and the only way to supercede a contract is with a Judicial order. I suggest you cooperate in every way to find the vehicle and have it secured.
