    Default H1 B Visa acceptence

    Hi,

    I have already applied for H1B visa mine went in on Aug 4th and Aug 12th INS said quota reached? am I safe? I did get receipt and all. What are the reasons for getting rejected in H1B visa....

    I have stayed here legally and never being legal. Should I worry??? I wanted to go for premium processing but my lawyer was saying I am fine all the time.....so went for the normal process.

    What are the steps to take if by any chance if i got rejected????

    If you have posed these questions to your lawyer and your lawyer has assured you that everything is okay, we're in a poor position to second-guess that assessment.

    ok I understand but am I really safe? how does the INS quota exceeds handle. lets say someone apply after the quota? do they inform quota is reached or do they send a recp. number?

    Hi,
    I have the same problem..
    my sponsor filed petition for me on august 4..
    do i m safe for getting approvel..
    as on online status it still shows that this type of case will took 90-150 days to process..
    how can we know that we need premium processing?

    As long as your H-1B application was received before August 10, you are fine. Cases received on August 10, 2005 are subject to random drawing.

    This does not apply to cases filed for individuals with U.S. masters' degrees or above who are eligible for one of the 20,000 special H1B cap exemptions.

    It is your decision to use a premium process or not. Often, it is beneficial to use it.
