My husband applied for employment with Sheriff's department. Part of the process is to pull credit report. When pulled they indicated that he needed to clear up 5 outstanding debts on his report. 1 had already been paid threw a settlement with collection account to avoid judgment as judge indicated that the SOL on cc account was 5 years and not 3 years as we asserted as our affirmative defense to being sued by the collection agency. This just hadn't been updated on the CR. The other 4 were Capital One, First Premier, Arrow Financial and Persidio/CM. Apparently, First Premier and Arrow financial are trying to collect for the same debt as Arrow Financial is the assigning company for First Premier, but First Premier is reporting to credit bureau as though they still own the debt and not been assigned to Arrow Financial.

We immediately sent certified letters to the creditors requesting validation and disputed the items with the credit bureau (4/27/07). Credit bureaus findings from the investigation, "valid". We waited to hear back from the creditors. Capital One responded with "We can't locate any account with the information you have provided us with. Please provide us with more information." I provided them with the EXACT information that I had which was the information they were reporting to the credit bureau. No response from Arrow Financial or First Premier. In May Presidio/CM sent us copies of the cc statements from 2/01-5/03, last payment was made 9/02. These statements also show that the cc account #'s changed 3 times from 01-03 and from a Visa to a MC, but none of the cc #'s match any of the original creditor account #'s showing on the CR.

On 6/17/2007 I followed up with letters (minus Presidio/CM) stating that they were now in violation of the FCRA and that they must remove the information for the CR within 15 days. We pulled the report a month later and the accounts were still there. We filed another dispute with the credit bureaus and in August they stated that they accounts were accurate. I copied all correspondences and sent them to all 3 credit bureaus and stated that these companies were violating my husband's rights and that they must remove the information. Their response was that according to their investigation that information was accurate and that if I still disagreed with the information I needed to take it up with the creditors. How can I when THEY WON'T RESPOND TO ME, or even know who we are!

Sheriff's department stated that even if the information is still on the CR, so long as we have letters showing that the accounts have been paid or are being paid that he can move forward in the hiring process. Amounts that are outstanding are only about 4k, would be more than happy to pay them if in fact they are his debt and the SOL hasn't expired, but how can I if I can't get anyone to respond to our request for validation?

What can we do to get this resolved? Should we file suit against them? Is the judge correct that the SOL on cc is 5 years and not 3 years? What state's SOL do we go under if the original debt was incurred when we lived in MA and we moved to VA in 2004? The last payments on these debts were in between 8/02-10/02?

We have already seen two attorneys who have stated that we have already done everything that they would have done (minus the filing suit part). Is that the next step or is there something else that we can do before that? If we should file suit should we retain an attorney? What area of law should this attorney practice in?

Thank you in advance for any light you can shed on this issue as he has been denied employment because of these issues and can't get employed with the Sheriff's department until they are resolved.
