Why are sex offense cases so easy to get into the courtroom?
Why are sex offense cases so easy to get into the courtroom?
That is an opinion based on your limited expereince. Its doubtful you can get any real answer and if you do it will not change your case or its outcome
Our law enforcement is growing increasingly corrupt everyday. It saddens me how little is being done to prevent it. I guess nobody cares about civil rights anymore.
The Great Blue Eagle.
All it takes to get a case into court is a unfounded accusation with no physical proof (he said she said). Reform will not ever happen when the majority of the public believes that most men could be sex offenders given the right circumstance. Crimes with out proof should not be prosecuted, but that would not get prosecutors reelected now would it.
The thing that gets me the most is the fact that I am paying these high lawyer fees to keep me from going to jail for an accusation that never took place. And by reading the complaint I am going up against the state and it list the complainant as the Sheriffs Deputy who took the girls statement. And when then is all said and done, who do I go after to recoupe the money lost?
Wait ... what??!?!
How is filing alleged cases with the DA an indication of corruption?
If someone reports a sexual assault, molestation, or rape, we expect the police to look into it and generally to forward their findings to the prosecutor and to child welfare offices as appropriately?
Since when has THAT become defined as corruption?
Last time I checked, detectives did not get a toaster or a microwave oven for filing a sex offense with the DA.

The complaint is made by the investigating officer and charges are filed by the DA. The victim and even his or her family do not HAVE to want anything done. If the state feels there is a case to pursue, then they can pursue it.
Out here very few sex offenses make it to court because of the lack of evidence. I'd say maybe one in six that are reported to us get a filing, and most those are either disposed of with a plea or dropped by the DA before trial. Very few actually make it to a trial.
As one who supervises sex crimes detectives, I have to say that these are often difficult cases to make. The accusations are easy, the proof can be tough.
It is simply not true that these matters "easily" get into the courtroom. At least, such is the case in most of the country. There may be isolated prosecutors that are overzealous in these regards, but I suspect they are in the minority.
But, keep in mind that a DA that does not at least file on a sex case where there exists probable cause to support an arrest is a DA that may not survive the next election. So, they might file on a decent case, but they may drop the matter if the defendant holds firm and no good evidence is forthcoming from the investigation.
