    Default Roommate Said They'd Move But Now Won't

    Roommate and I are both on the lease in San francisco, CA. Lease is up Feb 1st. Roommate gave me written notice that she would move on Jan 1st. She also gave notice to the landlord she would move before end of lease and he's fine with it.

    Previously the landlord has handled deposit as such: new roommate moves in and pays deposit to person moving out. I don't know if that is legal but its worked out okay so far. Until now. The departing roommate, at her own suggestion, and I agreed she would be refunded the deposit the day she moves out. Now she's in a financial crunch and wants the deposit refunded today or she says she won't move until Feb 1st. Can she renege on her written notice? Can the landlord allow this? What are my legal rights with the deposit?

    You're not her landlord, so it's a question of what your landlord allows.

    What "legal rights" are you asking about, in relation to the deposit?
