    Default Apartment Flooded, LandLord delaying actions.

    My apartment was flooded recently due to water heater break. Around 40 Gallons of water flooded all my rooms. The carpet in the room which was fully wet was not removed by the landlord for 2days after flooding.

    The landlord also asked me to keep the AC on so as to dry the floor after the carpet was removed. I pay all the utilities. I am staying in a hotel for a week.

    After a week mold is forming on my walls. I have also lost money because I did not work for 2.5 days.

    I have apt insurance. But Can I file a lawsuit against my landlord for failing to promptly take action to replace the carpet and cleaning the apartment.

    The apartment is in New Jersey.

    Default Problem with Apartment

    Is your landlord paying for your hotel room?

    You may have a constructive eviction claim, or a claim for a rent abatement for the period that the apartment is unlivable. It is hard to know whether the landlord's delay in addressing the flooding was undue - why was there a two day delay?

    No. The Landlord is not paying the hotel. They are passing the buck to insurance.

    For two days they said we will extract the water and dry the carpet rather than replacing it.

    Once the carpet was out they insisted on letting the floor dry by opening the windows and keeping the AC on rather than using a de-humidifier or some other equipment.
