    Default Caught Shoplifting Items At Target

    Yesterday my girlfriend and I were caught shoplifting at a target in. I'm going through some financial trouubles, and we thought that we could get some christmas presents. I've never done anything like this before (I've never even gotten a traffic ticket), and I don't know what's going to happen. They added the amounts of our items together and said we were both being charged with class B Misdemeanors, even though my girlfriend had less than 50 dollars on her.

    I have been told that I will probably be able to get deferred adjudication, but for a class B misdemeanor I will only be able to get it covered up by a non-disclosure. Is there any way to get mine, my girlfriend's or both dropped to class C (Which I believe can be expunged)? Also, if it remains a class B and I get deferred, will future employers be able to see it when it gets "nondisclosed"?

    Lastly, what would stop a judge from giving me differed on either the class B or class C since it's my first offence of any sort? What about my girlfriend (she's had 2 speeding tickets, but that's all.)

    Are we go guess that you're in Texas? If so, work with a criminal defense lawyer to try to get a charge reduction and deferment.

    What might cause a judge to not defer your sentence? Bad attitude? Incredible tales, such as your trying to convince the court that this was your very first time shoplifting. (First time caught, perhaps... First time charged, apparently... But your story suggests that you've done this a lot.)

    What you need is an Attorney and you can then discuss with him/her your options including diversion or reduction in charges.

    What is it that suggests I've done this a lot? I won't lie and say it's the first time EVER, but it's not something I do very often. Usually I've taken food from grocery stores, this is the first time to ever take anything from a store like target.

    Also, yes I'm in texas... Any idea how much a defence lawyer will cost me? I've started giving blood in a local 'plasma donation' program for 175 dollars a month, and working at a bookstore, but I still don't know how much I'll be able to afford.

    Will a misdemeanor like this affect me greatly when applying for a job? I will work as much as I have to to make money to pay a defence attorney if that will really help me get this stupid mistake off my record... Some people have told me that you can get a 'diversion problem' but I don't know if I'm too old... (19) even though this is my first offence...

    One last question, how long does deferred last? a few months, years?

    You need to talk to an Attorney. Yes a conviction can have a very negative effect on your getting a job. Who wnats to hire a thief!? When you meet with the Attorney discuss your opitions like diversion if available

    If you are a future law student, that implies that you are an adult. This arrest, diversion or not, will be on your record FOREVER. Arrests aren't like credit reports where it drops off.

    If you are a future law student then you need to consider what impact these crimes (and you know its a crime) will have.

    Christmas in college sucks, especially when you want to get a nice present for your girl. That nice present will come in 6 years when you graduate top of your class and get your first law job. The best present will come in 30-35 years when you all can retire comfortably, having sent your kids through college (even if they were on scholarship).

    Quit doing things that will F- up your life. If those items were $250-$300 or over you could be charged with a felony and a felony charge will make you go from future law student to future license plate maker with no hope of law school.

    When I studied criminal justice the instructor told us a story of a student of his who played mailbox baseball as a kid (a felony arrest). The kid could not get a job anywhere after graduating top of his class. The instructor told us if we had been arrested for a felony to either leave the room after the break or just not return to class and get a refund or select another major and get into some of the basic classes until they decide a new major.

    It should not be that serious, but it may just be that serious!

    You may discuss (at a later date) the chances of having your arrest record expunged. This of course if you meet diversion requirments and are successful with it.

    Yes, Isuppose I am an adult, I'm 19.
    They charged me with a class b misdemeanor, and its my first offence... Will this ruin my chances of getting into law school or getting a job? How will I be affected if it's expunged?

    A class B may affect you a little if you are an A student trying to get into top law schools. It will even affect you for some of the other good law schools. ...but it is not a Felony arrest, which should keep you in the clear. If you can get an attorney to work with the DA to see if they would accept diversion you may be able to complete this without a conviction on record.

    How much should an attorney cost me? I'm already 10k in debt from college loans, and bail fees... What are my chances of getting diversion, or something else that keeps this off my record? How about diferred?
