    Default Moving for a New Trial

    What procedures do we follow in order to file for a new trial? Our trial ended in a "guilty" verdict. Our attorney failed to question a doctor/expert witness for the prosecution whose physical examination of the victim indicated "recurrent rectal abuse" for which I was not accused of. My accusation was "digital penetration of the vagina...however slight" for which the expert saw no evidence. My attorney purposely, declined to cross-examine the expert on her finding, even after my insistence to do so. What can I do about this? Can I ask for a new trial before sentencing? Please answer.

    Default Moving for a New Trial

    I suggest you consult a different criminal defense lawyer about the possibility of petitioning for a new trial. One of the grounds you would presumably want to raise is ineffective assistance of counsel, which is difficult to do through the attorney you are accusing of being ineffective.
