    Default Am I Due Minimum Wage

    Hello

    I have recently taken this job with a Recruiting company that does not presently have an office in my State.
    I am supposed to solicit candidates for them via Internet from Home or wherever using my own expenses.
    However, I am occasionally being asked to work in a certain way , make data entry operations that take up a lot of time.

    My question is that the employer does not pay me and my work is only commision based.
    I may be categorized as an Independent worker for tax reasons but as I read on the IRS Website, for an IC the employer does not control how I carry out my job functions.
    Am I due minimum wage from my employer even if I am an independent worker considering I am still doing work for the employer which costs labor on my part.

    Also, I would like to mention that I am on a work permit here. is the Minm wage law applicable only for US Citizens ?

    I don't know from your post whether you could be classified as an employee; I suspect not, but I have nowhere near enough information to know. (Why would you want this work?)

    I will keep it only till the time I get another one .
    But just want to know if I am working for someone who is just taking me for a ride.

    So what makes one an employee ?
