    Default Dating Someone While Getting a Divorce

    I began dating someone going through a divorce, after he was served.
    It has come to our attention that a private investigator has been camping out a few houses down from his. So we are assuming they are staking him out.
    What can his soon to be ex wife do to us? She's the one who left and took everything while he was out of town to tend to his mother who passed away that very week.
    Is there anything I can do to protect myself from her?
    Can't he date while in the process of getting a divorce, or does he have to wait years to until this is all final?

    Presumably she wishes to try to argue that he had a relationship which contributed to the marital breakdown, or is involved in a relationship which is relevant to any custody disute (in the event that custody is an issue). Your boyfriend should discuss the situation with his lawyer.

    She has all the community property and all his seperate property. (Which he has receipts, and his family has reciepts for the gifts they gave him during the marriage, and items they bought for him while he was still in college single). He's got all the debt.

    What does she really have to gain? Texas is a no fault state, she filed as irreconciable differences. Would she have to refile if she wanted to state the claim he was having an affair?

    No children are involved, they were married for 3 years, right out of college.

    Irony is he supported her all through law school, literally the day she finishe the Bar, she filed. And so he paid to screw himself over.

    Default Professional Degree

    Most states view a graduate degree earned during a marriage as a marital asset, subject to division. That is, he can probably make a monetary claim against the value of her degree. So she may be seeking ammunition to use against him in the event that he attempts to do so. Again, he should discuss this with his lawyer.

    It is illegal to have sexual relations with another woman/man if you are still legally married.
    Charges can actually be filed for it.
